Information Collection and Use
When you download and use the App, we will learn certain information about your use of the App, and through any requests, reviews, or complaints that you voluntarily provide to us, may learn certain information about you.
Consistent with our previous practices, we will only collect and process your personal data when we have a lawful basis for doing so. These lawful bases include when you provide us consent, when we have a contractual obligation to collect or process the data, and when we have a legitimate interest in processing your personal data.
We may collect and/or receive the following types of information from you:
Information Provided Voluntarily
Personal, Order & Billing Information.
When you subscribe to the free, or paid version of the App, we collect your name (first and last), email, and phone number. We also are provided with your level of subscription.
We are not provided with your payment information when you subscribe to the free or paid version of the App through either the App Store or Google Play.
However, this data may be collected separately by this or any other platforms where the App is available.
As a reminder, because we do not collect payment information directly related to your subscription to the App, for any refund requests related to the App Store you must contact the App store directly. For any refund requests related to Google Play, you may contact us, in accordance with the Terms of Service, and while we can issue a “blind” refund, we do not have access to your payment information.
Purchases Inside of the App
For any in-App purchases through our Shopify store, the following information is collected in order to transact the purchase:
- Your credit card information and billing address (both encrypted)
- Your shipping address for delivery of the product or products
Of this information, we receive your shipping address, which is tied to your user account.
You may pay for in-App purchases using ShopPay (Shopify’s payment processor), PayPal or Google Pay. All are encrypted and protected processing options.
Your Personal Information Entered Into the App
If you are utilizing the App to set weight, macro and workout goals, we do collect some key information from you to support your health journey, including your:
We utilize this data to support your goals and tracking within the App. This data is also reviewed in aggregate to improve our services and make informed business decisions.
We otherwise do not access, collect, or retain any of the information, personal or otherwise, that you may enter into the App, including your notes, pictures, or other content stored on your device or in the cloud. Any photos entered into the Progress Journal are encrypted for your protection.
While we do collect usage data which helps us to understand how our users use the App, we do not collect any data related directly to your calendar, camera, contacts, microphone, sensors, sms, or storage on your device. While you can use your microphone feature to help enter data into the App, and use your device to upload photos into your journal (or download them again), we do not separately access or store this information.
If you submit a request or complaint to us via the App, or via our website, we would have access to this specific user data, including personal data if you provide it; otherwise we are not interested in collecting user specific data outside of what is detailed below.
Personal Information provided through CHALLENGE RELATED SUBMISSIONS: If you decide to participate in the Challenge through the App, you may submit, and we may collect, the following types of information as part of your voluntary participation in the Challenge:
- Before and after measurements as either required or permitted within the Challenge;
- Before and after photos as either required or permitted within the Challenge;
- Any other information relevant to your Challenge experience that is collected within the Challenge
You represent that your participation in the Challenge is voluntary, and that you agree that any of your information submitted as part of the Challenge may be published or shared by the Company, including if you are selected as a winner.
Information Collected Automatically. The information that we do collect largely falls into the category of log data, specifically in regards to your use of the App, as follows:
Activity Info (Log Data). There is a certain amount of log (usage data) that we collect related to your use of the App, including your IP address, IDFA, IDFV, GPS ADID, Android ID, as well as your device make, model and operating system.
Usage data also includes access dates and times; the configuration or version of the App when utilizing it, country location, network type, and other related data including download data (i.e. how many people download the App).
This data is generally reviewed in aggregate, to look at usage and performance metrics, and not at any individual user’s specific use.
Other Third Party Service Providers. We may use third-party companies, individuals or services:
- to facilitate the delivery of the App;
- to perform App-related services;
- to assist us in analyzing the performance of the App;
- to assist us in analyzing how the App is used and collect usage data;
- to provide us with data regarding the geographic location of our visitors; and
- to provide improvements to the App.
How to Access Your Personal Information
If you have submitted a request or complaint to us, we may have personal information about you (i.e. name and email address and any other information that you provide to us) in our system. Please note that if you separately sign up through our Website to hear from us, you may receive marketing communications related to your request for such. To manage your receipt of marketing and non-transactional communications, you may unsubscribe by clicking the “unsubscribe” link located on the bottom of any related email from the Company. Emails related to the purchase or delivery of orders are provided automatically – Customers are not able to opt out of transactional emails. We will try to accommodate any requests related to the management of Personal Information in a timely manner. However, it is not always possible to completely remove or modify information in our databases (for example, if we have a legal obligation to keep it for certain timeframes, for example).
How We Use and Share the Information
We use the collected Information to understand customer needs, including regarding our App related services to:
- present you with information through the App;
- provide our services and process orders;
- maintain and improve the App;
- respond to your requests, and provide customer service, including in response to any problems that may arise;
- solicit your feedback, and to inform you about our products and services and those of our third-party marketing partners, if any, that we feel may be of interest or value to you;
- personalize or display advertisements to you on third-party platforms;
- improve our services or offerings; and
- fulfill our legal or contractual obligations to you.
As with transactions elsewhere, when you purchase products, services, or programs via our App or Website, your credit card company will also retain certain information regarding your purchase. We will not otherwise provide any personal data to your credit card company without your permission.
We may share the Information collected with joint venture partners, affiliates, agents, current or prospective business partners, businesses under common control, third-party businesses or partners participating in administering our programs or services, or to those providing business functions such as technical support, customer service, marketing assistance, etc. These businesses will only have access to information as necessary to perform their functions and to the extent permitted by law.
In the event of the sale or transfer of our business to a third-party buyer, including in the event of bankruptcy or liquidation, we may, as necessary, share your data with the buyer or transferee.
In the event that we have to collect on a debt owed to us by you, we may, as necessary, share your information with an attorney or a court of law to enforce our rights and collect what is owed.
Under certain circumstances we may be obligated or compelled to disclose the Information: when required by law, court order or government agency, or when disclosing such Information is reasonably required to protect the Company, its property, the Website, the safety of visitors or others.
Retargeting / Personalized and Behavioral Ads
We may, using the techniques described above, and in conjunction with third party marketing partners, gather information from your use of our App (or Website) for purposes of providing relevant advertising content to you in the future. This means that through third-party marketing partners or third-party sites such as Google, Facebook, or Instagram, we may display advertisements to you (remarketing or retargeting), based on usage data collected during your visit to our App.
App Analytics: As described above, we use Analytics in conjunction with the App. This helps us to better understand the User experience of the App, improve and update the App, support innovation and improve the User experience.

Security of Your Information
The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we incorporate standard industry practices internally and with our service providers, which we believe is sufficient for the information involved, we cannot guarantee its absolute security. Because we work with third-party businesses and vendors in various aspects of our business including in making the App available, database management, App and data security, etc., we cannot guarantee the absolute security of our database, nor can we guarantee that the Information you supply will not be intercepted while being transmitted to and from us over the Internet or with third-party businesses that support our delivery of the App. Any information that you provide to us via email or online or through the App should be treated with extra caution, as we cannot control the level of security available through email providers or with third-party businesses or platforms that help to make the App available.
We are strongly committed to protecting the safety and privacy of children who visit our website. We do not knowingly collect Personal Information from children under the age of 13 through the Website. If you are under 13, please do not give us any Personal Information. We encourage all parents to talk to their children about online safety and to monitor their children’s use of the Internet. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please contact us, and we will make best efforts to immediately delete that information from our databases.
California Privacy Rights
Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business with whom the California has an established business relationship, certain information with respect to the types of personal information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year. Our California Do Not Track Notice
Consistent with our policies described above, we collect information from our visitors on our website and across third party websites where applicable, to provide relevant content and advertising. We do not support Do Not Track (“DNT”) signals of web browsers.
DNT is a setting in your web browser that informs websites that you do not want to be tracked. You can enable or disable DNT through the Preferences or Settings options of your web browser.
Visitors Outside of United States
Our Website and the servers that make this App available worldwide are located in the United States. The Internet laws in the United States govern all matters relating to your use of this App. Any information you provide in subscribing to or visiting our App will be transferred to the United States. By visiting our Website or App and submitting information, you authorize this transfer, processing, and use.
EU Visitors and the GDPR
If you live in the EU, certain of your data may be subject to protection by the General Data Protection Regulation (the “GDPR”), a privacy regulation intended to help you have greater control over your personal data.

The data is only kept as long as is reasonably required to accomplish the purpose or purposes for which it was collected. Certain data may be expunged or utilized more quickly than others, and depending on your engagement and behaviors, including purchasing behaviors, we may be engaged in a business or contractual relationship with some longevity. The categories of data processors with whom we work, and that help us in the collection of information that allows us to serve and interact with you include App-related analytics provider(s), other App-related third-party services that allow us to maintain an up-to-date and functional App and communicate with you electronically, an email service provider or providers to assist in managing email correspondence with our visitors, customers and list, and to respond to user requests for assistance, as well as payment processor(s) and/or merchant account(s) to help us transact sales online and within the App and follow up with you regarding any purchases. Those within the Company that may have access to the data include Officers, Directors, Managers, Supervisors, Salespersons, or those providing customer or technical support, including App developers. Access to the data is provided for specific purposes, generally related to communicating with you, fulfilling our contractual obligations, providing customer service or technical support, improving the App and use experience, collecting payment, or monitoring performance of marketing and sales efforts.
You may contact us at any time to have your information with us or any of these processors updated or corrected, deleted, or to obtain a copy for your records. Additionally, you may opt out of receiving any additional emails or marketing messages from us by clicking the “unsubscribe” link at the bottom of our email notifications.
